The loss of a loved one is a traumatic experience and an emotionally difficult time for a family. Unfortunately when you are dealing with the death of someone you love, there are numerous financial matters that may need to be dealt with in a rather expeditious manner.

Although you can find other attorneys who are competent in the area of estate administration, it is rare to find one who is not only efficient but understands the delicate nature of these proceedings. I have learned from my experience that being detached and apathetic does not serve any family during this difficult time. That is why my first priority is to take into account the personal nature of these matters. In doing so I am able to help families deal with their emotions before they have a chance to take over and cause irreparable harm to their relationships. I understand that money and possessions often cause people to do and say things that are potentially destructive, so I take great care in making sure that everyone understands the implications of their words and actions before any harm is done.

On the legal side, I am able to assist families with all of the technical aspects of estate administration. I start with assisting in the appointment of someone as fiduciary of the estate and then proceed to guide families through all of the estate administration issues. Although these issues vary from estate to estate, they all usually involve some of the following issues:

  • Determination of valid debts and assistance with their payment;
  • Collection, evaluation, transfer or sale of assets;
  • Continuation or sale of business interests;
  • Proper division of assets;
  • Preparation of final personal tax returns;
  • Preparation of estate tax returns and estate income tax return;
  • Funding of trusts; and
  • Estate and trust accountings 

It is impossible from a short description like this to provide the details of any particular estate. Every estate has its own issues and complexities. However, what I can do is make sure that the family understands all of the issues, makes educated decisions and, most importantly, does this in a way that will hopefully maintain harmony and peace during this difficult time.
